Claim by Solicitors for Damages Dismissed

Fitzpatrick, Wilkey & Thomas Boyd & Whyte v Commissioner of Police of the Metropolis [2012] EWHC 12 (Admin)

Ronald Thwaites QC secured the dismissal, following a 6 day trial of the claim brought by two individual solicitors and the firm in which they were partners for false imprisonment, unlawful search and seizure and breach of Article 8 ECHR.

The claim arose out of arrests and searches made to investigate alleged money laundering offences. In dismissing the case in its entirety the Court gave useful guidance on police powers of arrest, search and seizure for later sifting (under s.50 of the Criminal Justice and Police Act 2001), as well on searches of premises following arrest (under s.32 PACE).

At an earlier hearing the anonymity previously granted to the claimants was removed on the basis that it was contrary to the fundamental principle that justice should be open.
