Have you Herd? High Court decision on Cattle Trespass

The High Court has handed down judgment in Re Jenkins [2016] EWHC 426 (Ch) concerning a claim to damages for trespass over 400 acres of farmland on the Isle of Wight for a period of nine years. The Judgment addresses a number of points of law concerning the correct measure of damages for trespass over farmland, as well as dealing with the liability of owners whose agents drive their cattle over land, and when title to cattle is passed by personal representatives.
