Admin Court rules that there is no duty under the Children Act 1989 on metropolitan housing authorities to co-operate with social services

In R. (on the application of C) v Hackney LBC [2014] EWHC 3670 (Admin), the Administrative Court considered whether section 27 of the Children Act 1989 placed the same housing duty on a different department of metropolitan local authorities, as it does on housing district councils outside London. The Court held that it did not, since the wording of the section was clear and the duty did not arise in circumstances in which one department of a London borough requested the help of another department in the same London borough. If Parliament had intended that s.27 should cover the relationship between different departments within the same authority then it could easily have expressly provided for that.
