Mr Tim Kerr QC (Sitting as a Deputy Judge of the High Court) has – somewhat reluctantly – found in favour of Natwest and RBS in this latest battle in the ongoing war between the major UK banks and their customers, in relation to the mis-selling of interest rate hedging products. However, the banks’ success turned on a narrow point and claimants will likely find encouragement in other aspects of the judgment.
