Waiver in leasehold extension cases

In Re First Floor Flat, 83 Oval Road (Tribunal Reference AH/LON/ooAH/OLR/2014/0941), Faisel Sadiq (instructed by Gary Leverett of McMillan Williams Solicitors) successfully argue that a lessee was entitled to waive strict compliance by her landlords with the statutory timetable for serving counter notices in respect of claims for the grant of a new lease under Part 2 of the Leasehold Reform, Housing and Urban Development Act 1993.
